Terms of Use

Terms governing use of the hypersilk.io website. Governed by the laws of England and Wales. Please read carefully. Last updated April 2026.

1. Agreement

These Terms of Use ("Terms") constitute a binding agreement between you ("you," "your," "the User") and Hypersilk ("Hypersilk," "we," "us," "our"). By accessing or using the website located at hypersilk.io (the "Site"), you confirm that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not access or use the Site.

These Terms apply to use of the Site only. Separate written engagement agreements govern any commercial relationship between Hypersilk and a client; in the event of inconsistency between these Terms and any engagement agreement, the engagement agreement prevails in relation to the subject matter of that engagement.

2. About Hypersilk and the Site

Hypersilk is an external go-to-market agency providing marketing, KOL, media placement, community activation, and event services to Web3 and digital-asset clients expanding into Chinese-speaking markets. The Site exists to describe Hypersilk's services, network, and approach, and to receive inquiries from prospective clients.

The Site is offered on a free-of-charge, information-only basis. No fee is payable by Users for access to the Site.

3. No professional, legal, financial, investment, or tax advice

Nothing on the Site constitutes, or is intended to constitute, professional, legal, financial, investment, tax, accounting, or regulatory advice. Nothing on the Site constitutes an offer, solicitation, inducement, or recommendation to buy, sell, hold, deposit, stake, lend, borrow, farm, mint, or otherwise transact in any digital asset, token, cryptocurrency, security, derivative, or financial instrument. You should not rely on any content on the Site as the basis for any decision and should obtain independent professional advice before taking, or refraining from taking, any action.

4. Jurisdictional scope and no solicitation

The Site is directed at a commercial audience of Web3 businesses and their representatives in jurisdictions where such access is lawful. The Site is not directed at, and is not intended to solicit business from, persons in any jurisdiction where offering the services described, or where access to the Site itself, is prohibited or restricted by law.

Without limitation, nothing on the Site constitutes an offer, solicitation, promotion, or marketing of any financial product, security, or digital-asset service to any resident of the People's Republic of China, nor to any person in any jurisdiction where such offer, solicitation, promotion, or marketing would be unlawful or require registration or licensing that Hypersilk does not hold. Where local law imposes restrictions on the content or availability of the Site, it is the User's responsibility to ensure their access complies with applicable local law.

5. Acceptable use

You agree not to use the Site to: (a) attempt to gain unauthorised access to any system, server, or account; (b) probe, scan, or test the vulnerability of any system or network; (c) interfere with, disrupt, or overload the Site or associated infrastructure; (d) scrape, harvest, or mirror content for unauthorised redistribution, commercial reuse, or training of machine-learning models beyond what is permitted in Section 9; (e) impersonate Hypersilk, any Hypersilk personnel, or any third party; (f) submit false, misleading, or impersonated information through the contact form; (g) transmit automated or spam communications through the contact form; (h) engage in any conduct that is unlawful, tortious, defamatory, obscene, threatening, or that infringes the rights of any person.

6. Intellectual property

The Hypersilk name, logomark, visual design, website copy, structure, and code are the intellectual property of Hypersilk and are protected by copyright, trade mark, and other applicable laws. Nothing in these Terms or on the Site grants you any licence or right to use any Hypersilk intellectual property except as strictly necessary for ordinary browsing of the Site in a standard web browser.

Third-party names, marks, and logos mentioned on the Site (including but not limited to platform names, conference names, and media-outlet names) are the property of their respective owners and are referenced nominatively for descriptive purposes only. Such references do not imply endorsement, partnership, or affiliation unless expressly stated.

7. Third-party services and outbound links

The Site uses third-party services for infrastructure (content delivery, DNS, form submission, email delivery). The Site may contain outbound links to third-party websites. Hypersilk makes no representation as to the content, accuracy, availability, security, or privacy practices of any third-party service or linked site, and disclaims any liability arising from User interaction with such third-party services and sites.

8. Disclaimer of warranties

The Site is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, Hypersilk expressly disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, availability, uninterrupted operation, and freedom from error or malicious code. Nothing in these Terms excludes or limits any liability for death, personal injury caused by negligence, or fraud or fraudulent misrepresentation, which cannot lawfully be excluded.

9. Limitation of liability

To the maximum extent permitted by law, in no event shall Hypersilk, its members, officers, employees, contractors, or agents be liable to you for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, goodwill, data, opportunity, or contracts, arising out of or in connection with your access to or use of the Site, whether based in contract, tort (including negligence), statute, or any other legal theory, and whether or not Hypersilk has been advised of the possibility of such damages.

To the maximum extent permitted by law, the aggregate liability of Hypersilk to you in respect of the Site is limited to one hundred pounds sterling (GBP £100).

10. Indemnity

You agree to indemnify and hold harmless Hypersilk, its members, officers, employees, contractors, and agents from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; (b) your violation of any applicable law or regulation; (c) your violation of any third-party right; or (d) any content you submit through the Site.

11. Governing law and jurisdiction

These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms or their subject matter, save that Hypersilk reserves the right to bring proceedings against you for breach of these Terms in the jurisdiction in which you reside or in which your breach occurred.

Nothing in this Section affects any mandatory consumer-protection right that, under the law of your place of habitual residence, cannot be derogated from by agreement.

12. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable in any respect, that provision shall be severed and the remaining provisions shall continue in full force and effect. Where possible, the severed provision shall be replaced by a valid and enforceable provision that most closely reflects the original intent.

13. No waiver

No failure or delay by Hypersilk to exercise any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy. No single or partial exercise of any right, power, or remedy shall preclude any other or further exercise of that or any other right, power, or remedy.

14. Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Hypersilk in relation to your use of the Site and supersede all prior agreements, arrangements, and understandings, whether written or oral, on the same subject matter.

15. Changes to these Terms

Hypersilk may update these Terms from time to time. The "last updated" date above reflects the date of the current version. Continued use of the Site following any update constitutes acceptance of the revised Terms. If any update materially reduces your rights, a prominent notice will be displayed on this page.
